A Cupertino resident, Mark Fantozzi, has initiated legal action against the city and developer SummerHill Homes to halt a 51-townhome development on Linda Vista Drive. The lawsuit, filed on May 1, 2026, alleges that the 2.5-acre site sits in a 'Very High Fire Hazard Severity Zone' and that the city failed to conduct adequate studies regarding wildfire evacuation capacity for the area. Plaintiffs are seeking a court order to set aside the project's approval until additional environmental and safety reviews are performed.
The proposed development, which includes 10 affordable housing units, was approved by the Cupertino City Council in April 2026 to help satisfy state-mandated housing requirements. While the developer maintains that the project complies with zoning and general plans, opponents argue that the addition of high-density housing in a hillside corridor with limited access presents a significant public safety risk that was not properly addressed in the approval process.
