Federal Lawsuit Halts Work at 25-Acre Aspire at Old Guard Apartment Site in Columbus

Chattahoochee Riverkeeper files a federal lawsuit against the developer of the 25-acre Aspire at Old Guard apartment complex in Columbus for alleged Clean Water Act violations.

By Colin Percy · May 26, 2026

The Chattahoochee Riverkeeper has initiated federal litigation against SCorUSA and the Aspire at Old Guard apartment complex in Columbus, Georgia. The lawsuit alleges significant, ongoing violations of the Clean Water Act, claiming that the 25-acre construction site has failed to implement necessary sediment and pollution controls. This failure has reportedly resulted in excessive muddy runoff entering the local river system, adversely impacting downstream tributaries, private ponds, and Lake Oliver.

The environmental group, which first flagged the issue in 2025, moved forward with legal action after the developer allegedly ignored a 60-day notice of intent to sue sent in March. Despite the Columbus Consolidated Government issuing multiple stop-work orders—including one in early May—the Riverkeeper maintains that local oversight has been insufficient to rectify the damage. The lawsuit seeks a court-ordered injunction to halt further environmental degradation and impose civil penalties of $68,445 per day for documented violations.
